

Plums LLC dba PLUMS AUTO: GENERAL TERMS & CONDITIONS OF LEASE/SALE

1. AGREEMENT STRUCTURE & OWNERSHIP
Ownership: Plums Auto (Lessor) retains the legal title and full ownership of the vehicle until the final "Option to Purchase" payment is made in full by the Customer (Lessee).
No Equity Transfer: This agreement is a lease. The Customer does not build traditional equity in the vehicle until the final purchase option is exercised.
Transfer of Title: Upon successful completion of all scheduled payments, late fees, and the final purchase option fee (e.g., $100.00), Plums Auto will sign the title over to the Customer.
2. FINANCIAL TERMS, FEES, & TAXES
Rental Payments: Payments are strictly due on the dates outlined in the Payment Schedule.
Sales & Rental Tax: Because this is a lease, Arkansas state and local sales tax, plus the applicable Rental Vehicle Tax, are assessed on every payment.
Service & Handling Fee (Doc Fee): A one-time, non-refundable administrative fee of $129.00 is applied to all contracts at the time of signing, as permitted by Arkansas law.
Late Fees: If a payment is not received within 7 days of the due date, a late fee of 5% of the payment amount (or $15.00, whichever is less) will be automatically assessed.
No "Yo-Yo" Sales: Plums Auto strictly adheres to Arkansas consumer protection laws. Once this agreement is signed and the vehicle leaves the lot, the financial terms of this agreement will not change.
3. VEHICLE CONDITION ("AS-IS" DISCLOSURE)
As-Is Sale: Unless a separate written warranty is provided, the vehicle is rented/sold strictly "AS-IS" and "WITH ALL FAULTS." * No Implied Warranties: Plums Auto explicitly disclaims any implied warranties of merchantability or fitness for a particular purpose. The Customer assumes all responsibility for repairs after driving off the lot.
FTC Buyers Guide: The Customer acknowledges receiving, reviewing, and signing the Federal Trade Commission (FTC) Buyers Guide, which supersedes any verbal promises made by Plums Auto staff.
4. INSURANCE & LIABILITY
Insurance Requirement: The Customer must maintain continuous "Full Coverage" auto insurance (Comprehensive and Collision) for the entire duration of the agreement.
Lienholder/Loss Payee: Plums Auto must be listed as the "Loss Payee" and "Additional Insured" on the policy.
Lapse in Coverage: If the insurance policy cancels or lapses for any reason, it is an immediate breach of contract, and the vehicle is subject to immediate repossession.
Liability: The Customer assumes all legal and financial liability for any traffic violations, toll fees, impound fees, or accidents involving the vehicle.
5. MAINTENANCE & USE
Routine Maintenance: The Customer is 100% responsible for all routine maintenance, including oil changes, brake pads, and tire replacements.
Modifications: The Customer may not alter, customize, or modify the vehicle (e.g., window tint, aftermarket stereos, engine tuning) without written permission from Plums Auto while the dealership holds the title.
Geographic Limits: The vehicle may not be driven outside of the State of Arkansas for more than [Number] consecutive days without prior written consent from Plums Auto.
6. DEFAULT & REPOSSESSION (ARKANSAS LAW)
Default: The Customer is in default if they fail to make a payment, allow insurance to lapse, or provide false information on their application.
Right to Repossess: Upon default, Plums Auto has the right to repossess the vehicle without prior notice, provided the repossession can be completed without a "Breach of the Peace," as defined by Arkansas law.
Personal Property: If the vehicle is repossessed, the Customer has the right to retrieve their personal, non-affixed belongings from the vehicle at no charge.
Right of Redemption: Following repossession, Plums Auto will send a written "Notice of Sale." The Customer will have 10 days from the notice date to redeem the vehicle by paying the entire past-due balance, plus any documented towing and storage fees.
7. GPS MONITORING & STARTER INTERRUPT
Device Installation: The Customer acknowledges that the vehicle is equipped with a GPS tracking and Starter Interrupt Device.
Disabling the Vehicle: Plums Auto reserves the right to remotely disable the vehicle's starter if the account enters default.
Tampering: Any attempt to locate, remove, or tamper with the GPS device is a severe breach of contract resulting in immediate repossession.
